Federal Investigations and Grand Jury Subpoenas in Orlando

Legal Representation Before Federal Criminal Charges Are Filed

A federal criminal investigation does not necessarily begin with an arrest.

In many cases, individuals first become aware of a federal investigation when government agents request an interview, a grand jury subpoena is served, or a target letter is received.

These situations can be particularly stressful because the individual may not know the full scope of the investigation, what evidence the government possesses, or whether criminal charges are being considered.

Jordan Holmes Law represents individuals facing federal criminal investigations in Orlando and throughout Central Florida.

Contacted by the FBI or Another Federal Agency?

Federal investigators may contact individuals at their homes, workplaces, or businesses.

An investigator may describe an interview as informal or suggest that speaking voluntarily will help resolve questions about an investigation.

However, statements made to federal investigators can have significant legal consequences. Under certain circumstances, knowingly and willfully making a materially false statement in a matter within federal jurisdiction can itself constitute a federal offense.

Before agreeing to an interview, individuals should consider consulting an attorney who can evaluate the circumstances and explain their rights.

Federal Grand Jury Subpoenas

A federal grand jury subpoena may require the production of documents, electronic records, or testimony.

Receiving a subpoena does not automatically mean that the recipient has committed a crime or will be charged.

Nevertheless, subpoenas can raise significant legal issues, including compliance obligations, privileges, self-incrimination concerns, and the scope of requested materials.

An attorney can evaluate the subpoena, identify applicable deadlines, assess potential objections or privileges, and communicate with the government when appropriate.

A subpoena should never simply be ignored. Records potentially subject to preservation obligations should not be destroyed or altered.

Target Letters and Federal Criminal Exposure

Federal prosecutors sometimes notify individuals that they are targets of a grand jury investigation.

A target designation generally indicates that prosecutors or the grand jury have substantial evidence linking the individual to the commission of a crime and regard that person as a potential defendant.

Receiving a target letter is a serious development, but it does not mean that an indictment is inevitable.

Legal representation at this stage may involve evaluating the government's allegations, examining potential defenses, and assessing whether communication with prosecutors is appropriate.

Witnesses, Subjects, and Targets

Federal investigations may involve witnesses, subjects, and targets.

These designations describe different relationships to an investigation, and an individual's status can change as evidence develops.

Even someone who initially believes they are merely a witness may face legal risks depending on the facts and nature of the investigation.

Understanding those risks before providing testimony or documents can be essential.
