MOTION TO SUPPRESS GRANTED (DUI)
August 2026
Our client blew above a .08 BAC during his DUI arrest. While reviewing the body-worn camera and dash-board camera, however, our firm noticed some big problems for the State. We argued that the State did not have a reasonable articulable suspicion, in specific, articulable facts. The State was unable to prove that. The dash-camera video showed our client maintain a single lane or traffic and not cause a danger on the roadway, unlike what the Officer testified to. Additionally, the Judge disagreed with the Officer that our client had trouble handing over his Driver's License and getting out of the car. The Judge agreed with us... The result? MOTION TO SUPPRESS GRANTED. No Evidence = No Crime. DUI DISMISSED.
Practice area(s): Criminal Defense
Court: Osceola County
